GENERAL PROVISIONS

The present website www.bluelemon.ch (hereinafter “website”) is owned by Confezioni Damap Srl and is operated by Blue Lemon AG, with the registered address in Switzerland, Kasimir-Pfyffer-Strasse 11, CH-6003 Lucerne (hereinafter “Blue Lemon”).

The present general terms and conditions (hereinafter “Terms and Conditions”) regulate the relationship between the Customer (hereinafter the “customer”) and Blue Lemon (hereinafter referred to as “parties”) for the purchase of Blue Lemon products (hereinafter “products”) periodically available on the website. Access to the online boutique is permitted exclusively to customers, defined as follows: According to the purpose of the present Terms and Conditions, with the term “customer” we refer exclusively to the consumer, in any case to a person purchasing the products for non professional or business purposes.

The customer is requested to carefully read the points contained in the present Terms and Conditions, which are available on the website, in order to allow the customer to print and save these Terms and Conditions for future reference.

All the purchase agreements made with Blue Lemon through the website are governed by Swiss law.

PRODUCT AVAILABILITY

The following products are available for purchase online: nightwear, homewear, intimates, accessories and gifts.

All products are subject to availability at the time an order is placed. Blue Lemon reserves the right to vary the quantity and/or the type of products that may be purchased on the website at any time. The customer will be informed if the product requested is not available.

PRICES

All prices on the Site are stated in Euro. They don't include any Vat and applicable taxes. The prices are not comprehensive of the shipping and delivery charges.

Blue Lemon uses it's best endeavor to ensure that all pricing information on the Site is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a Product shall occur, Blue Lemon will allow the Customer the option to confirm the purchase of the Product at the correct price or to cancel the order. If Blue Lemon is unable to contact the customer the order will be treated as cancelled.

The ownership of the Product purchased on the Site will be transferred to Customer at the moment of the delivery on condition that Blue Lemon has received the payment for the entire value of the goods. In any event the risks of damages and or loss of the Product are transferred to the Customer at the time of the delivery.

ORDERING A PRODUCT

Product description and price are detailed on the page on which each product appears on the website.

To purchase the chosen product the customer must first complete the online purchase form following the instructions indicated on the website. The customer must then send the form to Blue Lemon. Then the customer adds the product to their "shopping bag" and, after having reviewed and accepted the shipping expenses, the Terms and Conditions and the general cancellation policy, may choose their preferred method of payment. At this point, the customer may proceed to “payment”.

PURCHASE AGREEMENT

The purchase agreement made between Blue Lemon and the customer shall be considered completed and duly entered into by the parties at such time as the order is duly submitted by the customer in accordance with the purchase procedure indicated on the website and after Blue Lemon has received authorization from the credit card issuer that the payment is accepted.

Blue lemon shall consider the order submitted by the customer binding only if the entire purchase procedure has been duly and correctly completed without any error traced by the website. Blue Lemon is not responsible for any errors caused by the technical malfunctioning of the customer's Internet connection service.

By submitting the order to Blue Lemon the customer acknowledges and states that he/she has reviewed and accepted all the indications provided in the purchasing procedure and he/she entirely accepts the present Terms and Conditions.

The online order form will be stored in the website’s database throughout the time necessary for the fulfillment of the order.

Blue Lemon will send the customer confirmation of receipt of the order via e-mail.

PAYMENT

The customer may pay for products and shipping expenses by credit card. Blue Lemon accepts the following credit cards: Visa, MasterCard, Post Finance.

The transaction will be charged to the customer's credit card only once the credit card data has been verified and only after Blue Lemon has received debiting authorization from the credit card issuer. Further, the transaction will only be charged to the customer’s credit card pending Blue Lemon’s verification of product availability. And lastly, the customer's credit card will be charged only once the order is ready to be shipped.

The customer’s credit card will not be charged at the time that the order is submitted.

SHIPPING AND DELIVERY

For security reasons the product(s) purchased through the website will be sent to the registered address.

At the time of delivery an adult over 18 years of age must be present to sign the delivery documents.

Delivery cannot be made to P.O. Boxes or BFPO addresses. These orders will not be processed.

For each order completed through the website, once the product(s) have been sent, Blue Lemon will issue an invoice for the shipped products, sending it via e-mail to the customer; once the invoice has been issued no modification of same will be possible. The shipping and handling expenses are to be borne by the customer and are clearly indicated in the online form. The shipping and handling expenses may vary depending on location and on the type of shipment requested (e.g. express overnight etc.)

All the products will be shipped via Swiss Post or other courier (hereinafter “courier”).

The order will be dispatched between Monday and Friday, excluding local and national holidays and festivals. Blue Lemon is not responsible for unforeseeable delays.

For the delivery of the products the customer or a person authorized by the latter must be present at the address indicated in the order. At the time of the delivery by the courier, the customer shall verify that the number of boxes delivered is the same at that reported on the transportation documents and that the packaging is not damaged or wet or has been tampered with in any other way. Any damage to the packaging and/or to the product(s) or any discrepancy between the number of boxes actually delivered and the number of boxes indicated on the transportation document, shall be immediately reported in writing in the indicated space on the courier's delivery documents. Once the customer has signed the courier's delivery document, the customer may not file further complaints based on the condition of the external packaging of the delivered goods.

In the event that Blue Lemon should be unable to complete delivery due to sudden and temporary unavailability of the products, Blue Lemon will promptly inform the customer within thirty (30) days via e-mail.

The amount paid by the customer will be refunded as quickly as possible and within thirty (30) days from the receipt of the order submitted by customer.

RETURNS AND CANCELLATION

Blue Lemon strives to assure complete customer satisfaction. Blue Lemon will refund the entire cost of any product(s) returned by the customer as long as the aforementioned have not been worn, used or damaged and are accompanied by the correct invoice.

The refunds will be issued in the same form as payment rendered.

The purchased goods may be returned within a maximum of 7 (seven) days from the delivery date.

Products purchased online cannot be refunded or returned in the outlet stores.

The delivery costs are not refundable.

All delivery expenses for the return of the products shall be borne by the customer. Each and every cost borne by the customer for the return is not refundable.

Blue Lemon reserves the right to refuse the return of those products that have been worn, used or damaged as stated in paragraph one under “Returns and Cancellation.”

Blue Lemon will promptly send the refund within (30) thirty days from the written order cancellation request and receipt of the goods.

Once the refund has been completed, Blue Lemon will send a confirmation e-mail.

Blue Lemon recommends using a certified courier for the return of the product(s) so that shipment can be tracked.

Blue Lemon will not be held responsible for refunding the purchase price or for the replacement of any products that have been lost, stolen or damaged.

If the customer decides to modify or delete a submitted order, the Customer must immediately send an e-mail to the following address: home@dantemaria.com.

We at Blue Lemon endeavor to satisfy our customers. Please note however that once the product has been sent the order may no longer be modified or cancelled until the product has been duly returned to Blue Lemon. In the event of a cancellation or modification, please refer to instructions in the above paragraph.

ERRORS AND MISTAKES

Blue Lemon endeavors to keep the information on the website constantly up-to-date.

It is however impossible to guarantee the complete absence of errors on the Website. The website may contain typos, errors, or inaccuracies, some of which may refer to product price, availability or description.

Blue Lemon reserves the right to amend the errors and inaccuracies. This also applies after an order has been submitted. Blue Lemon furthermore reserves the right to amend or modify the information on the website at any time without prior communication.

GUARANTEE OF AUTHENTICITY

Blue Lemon guarantees the authenticity of all products purchased through the website. The best craftsmen manufacture all products bearing the Blue Lemon label using the best materials. Original Blue Lemon Products are sold on the Internet exclusively through the website www.bluelemon.ch. All intellectual property rights such as trademarks, service trademarks, labels and copyrights are exclusive property of Blue Lemon. No page or other content of the website may be reproduced without the prior written approval of Blue Lemon.

DEFECTS

Shall a Product purchased by Blue Lemon show a defect, the Customer shall immediately contact the customer care at the following address:

Shall the Customer be unsatisfied and/or for any discrepancy with the order submitted by the Customer, the Customer shall keep all the papers, the Product and it's box and contact immediately the company via e-mail at the following address: home@dantemaria.com.

APPLICABLE LAW AND JURISDICTION

The terms and condition for the access to the Site are regulated by the Swiss law and shall be interpreted in pursuance to the Swiss laws.

The Customer accept the non exclusive jurisdiction of the Swiss courts. For any controversy arising from or in connection to the navigation or the use of the Site the competent court shall be the court of Luzern.
